Handband Affiliate Program — Terms and Conditions

These Terms and Conditions (this "Agreement") govern your participation in the Handband Affiliate Program (the "Program") operated by Randall Communications Pty Ltd, trading as Handband ("Handband", "we", "us" or "our"). By submitting an application to join the Program, or by using any Program tools, links or assets after approval, you ("you", "your" or the "Affiliate") agree to be bound by this Agreement. If you do not agree, do not apply for or use the Program.
This Agreement applies to the Handband brand only. The Mediband Affiliate Program operates under a separate agreement at mediband.com.
1. Definitions
In this Agreement:
- "Affiliate Account" means the account you hold in the Aheadworks affiliate platform inside handband.com.au after your application is approved.
- "Referral Link" means the unique tracking URL or coupon code we issue to you and which records traffic and orders against your Affiliate Account.
- "Cookie" means the first-party tracking cookie placed in a visitor's browser when they click your Referral Link.
- "Qualifying Order" has the meaning given in clause 4.2.
- "Commission" means the affiliate fee earned on a Qualifying Order, calculated under clause 4.
- "Pillar" means one of Handband's four product audiences — Events, Schools, Fundraising, and Branding.
2. Eligibility and application
2.1 You must be at least 18 years old, legally able to enter into a binding contract, and own or be authorised to operate the website, social account, mailing list, podcast, organisation or other channel through which you intend to promote Handband.
2.2 We accept applications from individuals, sole traders, registered organisations, schools, P&C associations, federations, charities, agencies, and other entities worldwide. All applications are reviewed manually. We may approve, reject, or place an application on hold at our discretion. We are not obliged to give reasons.
2.3 We may reject or terminate an Affiliate whose channel:
- targets minors as the primary audience without adult moderation, except where the channel is operated by or supervised by a school, P&C, education provider, or registered youth charity in compliance with the applicable child-safety standards;
- contains hateful, violent, sexually explicit, or unlawful content;
- promotes products or services that conflict with Handband's brand values, including those that endanger children or vulnerable people;
- makes false safety, capacity, compliance or wristband-performance claims that misrepresent Handband products;
- has previously been suspended for breach of any Handband or Mediband Group program terms.
2.4 You are responsible for keeping your Affiliate Account credentials secure and for all activity on your Account.
3. Affiliate tracking and cookies
3.1 Cookie window. When a visitor clicks your Referral Link, a tracking cookie is placed in their browser for 45 days. If the same visitor returns to handband.com.au within 45 days and completes a purchase, that order is attributed to your Affiliate Account, subject to clause 3.3.
3.2 Attribution. Handband uses last non-direct click attribution. If multiple Affiliates are involved in a customer journey, Commission is attributed to the most recent Referral Link clicked before the Qualifying Order, except where clause 3.3 applies.
3.3 Override by Handband paid clicks. If a visitor clicks a Handband paid advertisement (Google Ads, Meta Ads, or any other paid placement) after clicking your Referral Link and before completing the order, the order will not be attributed to you. This rule prevents Handband from paying for the same conversion twice and is reflected in the Aheadworks platform configuration.
3.4 Cookie modification. You may not modify, delete, mask, append to, or otherwise interfere with the Referral Link, the cookie, or any tracking parameters. Any order resulting from a modified Referral Link is void.
3.5 Tracking failure. Handband is not liable for orders that fail to track due to a visitor's browser settings, ad blockers, anti-tracking software, or other circumstances outside Handband's reasonable control.
4. Commission structure
4.1 Headline rate and tier ladder. Affiliates earn up to 20% commission on Qualifying Orders. Every Affiliate starts at 15% base. Lifetime referred sales progress the Affiliate through a 5-tier ladder, with each step adding permanent commission on every future sale and shortening the commission hold:
Tier promotion occurs on the first Monday of each month based on lifetime referred sales. Once a tier is reached, it is retained permanently. Special seasonal campaigns (festival summer, formal season, EOFY fundraising) may apply uplifted rates from time to time, communicated by email to active Affiliates.
4.2 Qualifying Order. A "Qualifying Order" means an order that:
- was placed via your active Referral Link or coupon code;
- has been paid in full and reached "Shipped" status in Handband's order system;
- is not for excluded products under clause 4.4;
- has not been cancelled, refunded or returned;
- was not a self-referral or otherwise breached this Agreement.
4.3 Commission base. Commission is calculated on the product subtotal after any discounts, excluding GST, shipping, surcharges, design / origination fees, freight, and any third-party fees. Commission is paid in Australian Dollars unless your Affiliate Account is configured otherwise.
4.4 Excluded products and orders. Commission is not paid on:
- Handband Gift Vouchers;
- wholesale or bulk purchase orders processed under separate commercial terms (typically orders subject to a custom quote, supplier agreement, or master services arrangement);
- 2U-in-24 rush-production line items where rush surcharges apply (commission paid on the product subtotal only, never on the rush component);
- orders placed by you, your immediate household, your own business entities, or any school, charity, federation or association where you hold a paid operational role responsible for procurement (self-referral);
- orders placed using staff or partner discount codes;
- orders where a Handband paid click intervened in the journey under clause 3.3;
- orders processed under a special promotion that has been explicitly marked "no affiliate commission" by Handband (such promotions will be flagged in advance via the affiliate newsletter).
4.5 Commission status flow. Commission accrues with a status of "Pending" when the order item reaches "Ordered" status in our system, becomes payable upon "Shipped" status, and is automatically reversed if the order item is later moved to "Cancelled", "Refunded", or "Returned". This means your dashboard will show pending Commission that may not all become payable.
5. Payments and payouts
5.1 Minimum balance. You can request a payout once your available Commission balance reaches AUD $20.
5.2 On-demand payouts. You may request a withdrawal at any time through your Affiliate Dashboard, provided you have met the minimum balance.
5.3 Automatic safety-net payouts. In addition to on-demand requests, Handband generates payouts automatically every 14 days for any Affiliate whose available balance has reached the $20 minimum. You do not need to take any action for these.
5.4 Payment method. Payouts are made via PayPal by default, with bank transfer available on request for Australian Affiliates. Affiliates are responsible for providing accurate payment details. Handband is not liable for delays, loss, or fees arising from incorrect details.
5.5 Currency. Australian Affiliates are paid in AUD. International Affiliates may be paid in their local currency where supported, at an exchange rate set by our payment provider.
5.6 Tax. You are solely responsible for declaring and paying any income, sales or other tax owed on Commission earned. Handband does not withhold tax. Where required, we will issue an annual statement of payments made.
5.7 Donation routing. Schools, P&C associations, federations, registered charities, and not-for-profit organisations may elect to receive Commission as a charitable contribution rather than commercial revenue. Where this election is made, payouts are issued to the organisation's nominated charitable account and accompanied by a contribution acknowledgement, subject to clause 5.4 (accurate payment details) and applicable tax law in the recipient's jurisdiction.
5.8 Forfeiture. Commission balances that remain unpaid for 12 months after they become payable, and which the Affiliate has made no attempt to withdraw despite reaching the minimum, may be forfeited at Handband's discretion. We will email you at least 30 days before any such forfeiture.
6. Returns, refunds and chargebacks
6.1 If a customer cancels, returns or refunds an order on which Commission was paid or accrued, the Commission is reversed automatically. If the Commission has already been paid out, the reversal is offset against your next payout. If the offset would result in a negative balance, Handband may invoice the difference, which becomes payable within 14 days.
6.2 Chargebacks, fraudulent payments, and orders found to have breached Handband's customer terms are treated identically to refunds for the purposes of this clause.
7. Promotional conduct and restrictions
7.1 Trademark bidding (paid search). You may not bid on, or buy, paid-search keywords containing "Handband", any misspelling of "Handband", any Handband product name (including "Multibandz", "2U in 24", "Binder Bands"), the URLs handband.com.au or handband.com, or any combination thereof. This applies to Google Ads, Microsoft Ads, Meta Ads, TikTok Ads, and any equivalent platform. Breach voids all Commission accrued in any month a violation is detected and may result in immediate termination.
7.2 Direct linking. You may not direct paid traffic to handband.com.au via your Referral Link without prior written approval.
7.3 Coupon and deal sites. Affiliates whose primary channel is a coupon, cashback, deal-aggregation, browser-extension or "honey-style" platform are placed in a separate Coupon Tier with reduced commission. Affiliate-only bonus codes issued by Handband may not be posted to public coupon aggregators (RetailMeNot, Honey, OzBargain, Groupon, or equivalents). Codes posted to such platforms forfeit Commission on resulting orders.
7.4 Email and messaging. You must not send unsolicited bulk email, SMS, or messages promoting Handband. All email promotion must comply with the Australian Spam Act 2003, the US CAN-SPAM Act, the UK Privacy and Electronic Communications Regulations, the EU GDPR, and any equivalent law in the recipient's jurisdiction.
7.5 Social conduct. You must not impersonate Handband, Handband staff, or any Handband customer, on any platform.
7.6 Direct-to-organiser conduct. If your Referral activity involves direct outreach to event organisers, schools, P&Cs, charities, brand-activation agencies, or other procurement decision-makers on Handband's behalf, you must (a) identify yourself as an independent Affiliate, not a Handband employee or representative; (b) not commit Handband to any pricing, lead time, customisation, or service term not published on handband.com.au; and (c) route any quote requests to Handband via [email protected] or the relevant pillar contact form.
8. Content, claims and disclosure
8.1 Disclosure. You must clearly and conspicuously disclose your affiliate relationship with Handband on every page, post, video, podcast episode, email, or other piece of content that includes a Referral Link. The disclosure must be:
- in plain language;
- placed where the audience will see it before the link;
- specific (e.g. "This post contains affiliate links — if you buy through them, Handband pays me a small commission at no cost to you").
This requirement reflects ACCC guidance for influencers and content creators in Australia, the FTC Endorsement Guides in the United States, and ASA guidance in the United Kingdom. Compliance is your responsibility.
8.2 Product claims. Handband products are custom wristbands and related promotional items. You must not:
- claim Handband wristbands are medical devices, life-saving, or substitutes for any medical, safety or emergency intervention. Handband school-medical-ID and OSHC-ID products are identification aids only, not medical devices, and you must describe them as such;
- claim or imply that Handband wristbands are endorsed by any peak body, federation, charity, sponsor, agency, venue, school or other organisation unless that endorsement has been confirmed in writing by Handband;
- misrepresent production lead times, including the 2U-in-24 rush-production capacity. The 2U-in-24 service applies only to specific eligible products, quantities and order paths set out on the live 2U-in-24 page, and is subject to availability;
- guarantee or imply guaranteed delivery in time for any specific event without Handband's written confirmation of stock and dispatch for that order;
- make unsubstantiated comparative claims against other wristband suppliers or service providers.
Breach of this clause may, in addition to terminating this Agreement, expose you to liability under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), or equivalent legislation in your jurisdiction. We will provide approved descriptive language on request.
8.3 Truth in advertising. All claims about Handband products in your content must be accurate, current, and substantiated. You must not exaggerate features, fabricate user testimonials, or misrepresent pricing, availability, customisation options or guarantees.
8.4 Use of customer-facing imagery. Imagery featuring real customer events, schools, charity walks, brand activations, stadium moments or other identifiable Handband customer activity may only be used in your Affiliate content if (a) that imagery has been published by Handband on a public channel (handband.com.au, our official Instagram, Facebook, YouTube), or (b) you have separate permission from the customer organisation. You must not represent Handband customer events as your own work.
9. Trademark and intellectual property
9.1 Handband grants you a limited, non-exclusive, non-transferable, revocable licence to use the Handband name, logo, product images and approved creative assets solely for the purpose of promoting Handband under this Agreement.
9.2 You may not modify, distort or combine the Handband logo with other marks, except with prior written approval. You may not register any domain name, social handle, business name or trademark that incorporates "Handband" or any confusingly similar variation.
9.3 All goodwill arising from your use of the Handband marks accrues to Handband. The licence ends automatically on termination of this Agreement.
9.4 You retain ownership of content you create. By posting content tagged with a Referral Link or featuring Handband, you grant Handband a worldwide, royalty-free, non-exclusive licence to share, repost, and quote that content for marketing purposes, with attribution. You may revoke this licence in writing for future use, but Handband may continue to use content already published.
10. Confidentiality
10.1 The Aheadworks dashboard, sales data, commission rates outside the published headline tier, prospect lists, internal newsletters, supplier agreements, customer pricing, and any other non-public information shared with you under the Program is confidential. You may not disclose it to any third party, except advisors bound by confidentiality, without our prior written consent.
10.2 This obligation survives termination of this Agreement.
11. Privacy and data
11.1 Personal information you provide when applying or operating your Affiliate Account is handled under Handband's Privacy Policy at handband.com.au/au/privacy-policy/, the Australian Privacy Act 1988 (Cth), and where applicable, the EU GDPR and the UK GDPR.
11.2 You must not collect, store, share, or process personal information of Handband customers obtained through the Program. If a customer contacts you directly with a question, refer them to handband.com.au or [email protected].
11.3 If you operate an email list, mailing list, P&C newsletter, school community channel, or member newsletter, you are the data controller for that list. You must have the appropriate legal basis to send marketing email to its members and must honour all unsubscribe requests promptly.
11.4 Child-safe handling. If your Referral activity involves content directed at, or distributed within, an audience including minors (for example a school newsletter or P&C network), you must operate in compliance with the applicable child-safety standards, including the National Principles for Child Safe Organisations and your state or territory's reportable conduct scheme. You may not solicit, collect or publish personal information of minors in connection with the Program.
12. Fraud, audit and termination
12.1 Prohibited activity. The following activities, among others, are immediate grounds for termination and forfeiture of all unpaid Commission:
- self-referral (purchases by you, your household, or entities you control, including any school, P&C, charity or association where you hold a paid procurement role);
- cookie stuffing, forced clicks, hidden iframes, or any other technique designed to drop a tracking cookie without genuine user intent;
- placing fake orders, manipulating refund flows, or coordinating with customers to obtain Commission on orders that will be cancelled;
- creating multiple Affiliate Accounts to circumvent caps, tiers or restrictions;
- breaching clause 7 (paid search, coupon-aggregator policy, direct-to-organiser conduct);
- breaching clause 8.2 (product claims).
12.2 Audit. We may, on reasonable notice, audit your traffic patterns, conversion rates, source pages, anchor text, paid-media spend, and disclosure compliance. Refusal to cooperate with a reasonable audit is itself grounds for suspension.
12.3 Suspension and termination by Handband. We may suspend or terminate your Affiliate Account at any time if we have a reasonable belief that you have breached this Agreement, or if we choose to discontinue the Program. We will notify you within seven days of suspension. Where suspension follows a breach, unpaid Commission may be withheld pending investigation.
12.4 Termination by you. You may terminate this Agreement at any time by closing your Affiliate Account or emailing [email protected]. We will pay any Commission that has reached payable status by the date of termination, subject to the minimum-balance rule.
13. Limitation of liability
13.1 The Program is provided "as is" and "as available". To the maximum extent permitted by law, Handband makes no warranties, express or implied, in relation to the Program or any tools, dashboards, creative assets, or data feeds.
13.2 To the maximum extent permitted by law, Handband's total liability under this Agreement in any 12-month period is limited to the total Commission paid to you in that period.
13.3 Nothing in this clause limits any rights you may have under the Australian Consumer Law that cannot be excluded.
14. Changes to these terms
14.1 We may update this Agreement from time to time. The current version always lives at handband.com.au/au/affiliate/terms/. We will notify Affiliates by email of any material change at least 14 days before it takes effect.
14.2 Your continued use of the Program after a change takes effect is your acceptance of the updated terms. If a change is unacceptable to you, your sole remedy is to terminate this Agreement under clause 12.4.
15. Governing law and dispute resolution
15.1 This Agreement is governed by the laws of New South Wales, Australia.
15.2 Any dispute that cannot be resolved through good-faith negotiation within 30 days will be submitted to the exclusive jurisdiction of the courts of New South Wales.
